• Herbvive is a practitioner-only platform that provides contract manufacturing services for personalized herbal dietary supplement formulations.
• The platform is not open to the general public and does not sell directly to consumers.
• All products provided are classified as dietary supplements, not drugs or prescriptions, under U.S. law.

2. User Eligibility

Only licensed healthcare professionals such as:

• Licensed Acupuncturists (L.Ac.),
• Doctors of Oriental Medicine (DOM),
• Naturopathic Doctors (ND),

may register and place orders.

• Each user must submit valid credentials and pass manual verification.
• Herbvive reserves the right to reject, suspend, or terminate any account found to be non-compliant.

3. Practitioner Responsibility

Practitioners are solely responsible for:

• The accuracy and appropriateness of the formulas submitted;
• Compliance with applicable federal and state laws;
• Clinical outcomes and patient guidance.

Herbvive does not verify submitted formulas, does not provide medical advice, and does not endorse or recommend any ingredients or combinations.

4. Privacy & Data Security

• Herbvive processes all personal data in accordance with HIPAA, CCPA, and applicable privacy laws.
• Patient information submitted for labeling or fulfillment is used only for the intended order and is never sold, reused, or shared.

5. Prohibited Conduct

The following activities are strictly prohibited:

• Registration or order placement by individuals without valid credentials;
• Re-selling products to non-patient individuals or the general public;
• Promoting products using disease-treatment claims;
• Public display of formula content or labels without written permission;
• Copying or distributing website content, software, or trademarks.

Violation of these policies may result in immediate suspension or permanent account termination.

6. Limitation of Liability

Herbvive is responsible only for accurate production and fulfillment based on the submitted formula.

The company is not liable for:

• Misuse of products by practitioners or patients;
• Adverse reactions or clinical outcomes;
• Any form of off-label use or modification of formulas;
• Third-party shipping delays or losses.

7. Governing Law

• This agreement is governed by the laws of the State of California and the United States.
• Disputes shall be resolved in courts located in Los Angeles County, California.

五、禁止行为

以下行为严禁在平台上出现：

• 非执业人员注册或下单；
• 将产品转售给非患者或普通消费者；
• 以治疗疾病为名宣传平台产品；
• 未经授权公开展示标签或配方内容；
• 擅自复制、传播网站内容或软件界面。

如有违反，平台有权立即暂停或永久终止账户。

六、责任限制

Herbvive仅对根据医师提交配方进行的准确调配与配送负责。

平台不对以下情况承担任何责任：

• 医师或患者的错误使用行为；
• 产品使用后的不良反应或临床结果；
• 对配方的修改、擅自扩大用途；
• 第三方物流造成的延误或损失。

七、法律适用

• 本协议受加利福尼亚州及美国联邦法律管辖。
• 若发生争议，均应提交至加州洛杉矶县法院处理。
